Outside city limits, Environmental Services requires a Construction Site Permit, commonly called a building permit, to build, move or add onto a structure, and a new dwelling application must include a septic design. A separate building permit may be required in the townships that enforce the Minnesota State Building Code: Le Sauk, Lynden, Munson, St. Joseph and Wakefield. Cities permit separately.

Who decides the land use County zoning

Stearns County Environmental Services (Land Use and Zoning Ordinance 439)

Ordinance 439 applies to all of the county outside incorporated city limits. Primary districts include the A-160, A-80 and A-40 agricultural districts, two closed 20-acre districts, residential districts allowing one home per 10 acres or per 5 acres, a higher-density R-1 district, a rural townsite district and an urban expansion district, with shoreland, scenic river and floodplain overlays on top. The county encourages landowners and township governments to request rezoning of land in the two closed 20-acre districts to A-40.

Stearns County Environmental Services (SSTS Ordinance 422)

Septic systems (SSTS) fall under the county's Subsurface Sewage Treatment System Ordinance 422, effective 2010 and amended through 2021. Where an SSTS construction permit is required, it must be obtained before the building or construction site permit can be issued, and all site evaluation, design and installation work needs an MPCA licence.

Stearns County asks for a certificate of survey by a Minnesota-licensed land surveyor when the proposed construction is less than one and a half times the property line setback or the proposed impervious coverage exceeds 23 percent, and building plans are required in shoreland; it advises allowing at least three weeks for review.

Farmland is plentiful across Stearns County, but a building right is not automatic: in the agricultural districts the county counts homes against acreage, so a 20-acre split carved from an A-40 farm may not carry a new house. Check the parcel's district and whether its housing eligibility has already been used before you sign. The lake country in the south and west brings shoreland overlays, the Mississippi River corridor in Lynden Township carries the county's Scenic River District, and floodplain rules follow the rivers. Soils vary field to field, which is one reason the septic design and permit come before the construction permit. Do I need a building permit for a barndominium in Stearns County?
Outside city limits you need the county's Construction Site Permit, and the application for a new house includes the septic design. If the land is in Le Sauk, Lynden, Munson, St. Joseph or Wakefield township, a separate building permit and inspections may apply there as well. Inside a city, apply to that city. Can I build a pole barn home on farmland in Stearns County?
Often, if the parcel still has a dwelling right. In the A-40, A-80 and A-160 districts the county allows one home per 40, 80 or 160 acres, so the size of the farm and any homes already built on it decide what is left. Does the septic system have to be approved before I build?
Yes, where a new system is needed. The county's SSTS ordinance says the SSTS construction permit must be obtained before a building or construction site permit is issued, and an MPCA-licensed designer and installer do the work. Plan the drainfield location early, because it can decide where the house sits on the lot.
