Clay County Planning and Zoning
The Clay County Land Development Ordinance, adopted June 3, 2025, zones all land outside city limits. Its base districts are Agricultural General (AG), Agricultural Service Center and two highway commercial districts, with floodway, flood fringe and general floodplain districts and a shoreland system for lakes and rivers on top. Townships take part in each permit: an officer signs the application before the county gives final approval.

Clay County Environmental Health permits and inspects septic (SSTS) systems. Every new system needs a design, a permit and an inspection before it is backfilled, and an existing system must be certified by the county before a property is sold. The septic rules sit in Title 6 of the county code.

- Clay County's 2025 Land Development Ordinance allows up to eight single-family dwellings per quarter section (160 acres) in the AG district, entitles each quarter-quarter (40 acres) to two, and sets a 1.5-acre minimum lot and 200-foot minimum width for an administrative subdivision (Chapter 8-2 and Table 9-1).

- The county's permit page says an existing septic system must be inspected and certified when the building permit applicant is in the Shoreland Zoning District (within 1,000 feet of a lake or 300 feet of a river or stream) or is adding a bedroom (read 27 Sep 2026).
